Pre-launch legal draft
Operator legal name, registered address, monitored legal and privacy contacts, governing law, and final counsel approval are still required before production launch.
1. Scope and controller
This notice applies to the noma website, property search, saved favorites, seller intake, and buyer or renter inquiry services. It does not govern an agent, seller, messaging provider, map provider, or other third party acting under its own privacy notice.
The final operator legal name, registered address, and monitored privacy contact must be inserted before production launch.
2. Information we collect
- Inquiry information, including your name, email address, phone or messaging details, preferred viewing window, and message.
- Property and seller information submitted for a listing, including ownership or authority-to-list evidence when verification is required.
- Account, favorite, saved-search, and preference information if those features are enabled.
- Technical information such as IP address, browser type, device information, requested pages, timestamps, referral data, and security logs.
- Approximate location or map interaction data. Public listing pins are intentionally approximate and are not a seller's exact private address.
- Communications and support records, including fraud, safety, privacy, or accessibility reports.
3. Why we use information
- Provide property search, favorites, inquiries, viewing coordination, and seller intake.
- Connect a user with the relevant agent, seller representative, or service provider.
- Verify listings, prevent fraud, secure the service, enforce our terms, and investigate misuse.
- Respond to privacy, legal, safety, and accessibility requests.
- Maintain records required for transactions, disputes, compliance, accounting, or legal claims.
- Improve performance and usability using aggregated or de-identified information.
noma does not currently sell personal information or share it for cross-context behavioral advertising.
4. Legal grounds and consent
Depending on the law that applies, processing may rely on your consent, steps requested before entering a transaction, performance of a service, legitimate interests such as fraud prevention and service security, or compliance with legal obligations.
Where consent is required, you may withdraw it for future processing. Withdrawal does not invalidate processing that was lawful before withdrawal.
5. When information is shared
- With the agent, seller representative, property manager, or advisor responsible for the listing you contact.
- With hosting, database, communications, mapping, security, analytics, and professional service providers acting under appropriate instructions.
- When required by law, legal process, regulators, law enforcement, or to protect users, property, rights, or safety.
- As part of a financing, acquisition, restructuring, or transfer of the service, subject to appropriate confidentiality safeguards.
WhatsApp, map tiles, and other external services may receive technical data under their own privacy terms when you use those services.
6. International transfers
Service providers and users may be located outside Mexico. Where personal information is transferred internationally, noma will use the safeguards required by applicable law and will disclose material transfers in the final operator-approved notice.
7. Retention
- Favorites stored only in your browser remain until you remove them or clear site data.
- Inquiry and lead records are generally retained while an inquiry is active and then deleted or anonymized after approximately 12 months, unless a longer period is needed for a transaction, dispute, fraud prevention, or legal obligation.
- Security, audit, and compliance records may be retained for a longer period where reasonably necessary.
- Listing records may remain in archived form to document publication history and resolve disputes.
8. Your privacy rights
Depending on your location and applicable law, you may have rights to know or access personal information, correct it, request deletion or cancellation, object to or restrict certain processing, withdraw consent, request portability, and receive information about disclosures.
People in Mexico may have ARCO rights: access, rectification, cancellation, and opposition. California residents may also have rights to know, delete, correct, opt out of sale or sharing, limit certain sensitive-information uses, and receive non-discriminatory service where the relevant law applies. EEA and UK users may have additional data-protection rights where applicable.
We may need to verify your identity and authority before acting on a request. Some information may be retained where an exception or legal obligation applies.
9. Security and children
We use reasonable administrative, technical, and organizational safeguards, but no online system can guarantee absolute security. Do not send passport scans, banking credentials, payment-card details, or other sensitive documents through a general listing inquiry.
The service is intended for adults seeking property information and is not directed to children under 18. We do not knowingly request personal information from children.
10. Contact and updates
The final production notice must publish a monitored privacy request method, the operator's legal identity, and its registered or service address. Material changes will be dated and displayed on this page.
Service: noma. Primary launch market: Puerto Aventuras, Quintana Roo, Mexico.
